New Kratom Regulation Set to Take Effect in Georgia in 2025

Early in 2024, legislators put forward a bill that would ban kratom. Luckily, that didn’t happen. However, a few months later, kratom got a second look in a different way. In May, Georgia Governor Brian Kemp signed a law that will regulate kratom to make the products and industry safer for consumers and stakeholders. Here’s the latest on kratom in Georgia and how it can affect customers and enthusiasts.

Limiting Minor Access

The governor signed the law, which will take effect on January 1, 2025. It will prevent vendors and others from selling kratom products to customers younger than 21. Consequently, items must only be accessible to employees, such as in a display case or behind the counter, to keep them out of the reach of minors.

Limiting Alkaloid Concentrations

Further, the new legislation will limit how much mitragynine and 7-hydroxymitragynine, the primary alkaloids in kratom, can be placed in products. Lawmakers added this regulation to keep customers safer by preventing potentially dangerous amounts of these alkaloids. Newer kratom users can especially feel more comfortable with their choices since there’s a reduced risk of facing adverse side effects from too much mitragynine and 7-hydroxymitragynine.

New Labeling Requirements

Manufacturers must also follow proper labeling requirements, including recommended serving sizes. The label should provide an appropriate time frame to consume kratom safely. Kratom makers must also refrain from making bold claims about the effects of the products.

New Penalties for Violators

What happens if a manufacturer or vendor violates any of the new kratom legislation? They can face severe consequences and penalties. For example, a first offense of selling kratom to a minor is a misdemeanor with a fine of up to $250. A second offense can result in up to a $500 fine, and any additional offense will be $1,000.

However, if a person knowingly or willingly violates other parts of the law, they can face some extremely severe repercussions. That includes not labeling products appropriately. If that’s the case, the violator can face a felony that can land them in prison for one to 15 years. The offense can also result in a fine of up to $100,000. In some cases, the person will go to prison and have to pay a fine.
