In Florida, one lawmaker wanted to pass legislation to regulate kratom. Senator Joe Gruters had an idea of how he wanted the kratom industry to look in his state and has filed a bill to do just that in 2022. With the Kratom Consumer Protection Act (KCPA), Gruters hoped to improve kratom products for consumers. However, the bill faced some resistance, and a similar but very different bill was sponsored by Rep. Alex Andrade the following year. Which one won out, and where does kratom in Florida stand now? The Gruters’ Bill

In late November 2021, Sen. Gruters filed the Florida version of the Kratom Consumer Protection Act. The act would prohibit businesses from selling their products to anybody under 21. If passed, this would be stricter than most states since the minimum age is typically 18. Additionally, manufacturers would have to prove that their products are unadulterated and contain no dangerous ingredients through proper labeling. Ultimately, it failed to pass in the 2022 legislative session.

The Andrade Bill

Rep. Alex Andrade introduced his bill as a narrower version of Gruter’s in February 2023. In fact, this bill was almost entirely identical to another one filed that same year, with a few key differences. Because the bill wasn’t as overreaching as its predecessor, it passed the House and Senate more easily. Andrade admitted that he looks forward to expanding the bill sometime in the future. Eventually, the KCPA was signed and authorized by Governor Ron DeSantis.

What does the KCPA entail?

The bill legally defines kratom products to standardize the market. The hallmark of the bill is to prevent people younger than 21 from accessing kratom products. If a business is found guilty of selling to someone underage, they can land in jail for up to 60 days or a fine of up to $500.
