Introducing KCPA
In 2018, industry leaders and proponents introduced the Kratom Consumer Protection Act (KCPA) “to regulate the preparation, distribution, and sale of kratom products; to prohibit the preparation, distribution, and sale of adulterated or contaminated kratom products.” The KCPA can trigger fines and penalties if sellers or brands break these rules. The act also paves the way for more research on the plant. Many view it as a compromise between lawmakers and advocates.
Top Priorities
The KCPA offers several priorities to ensure that kratom continues to have a bright future. These include:
• Protecting consumers by standardizing the methods in which kratom is produced and sold to increase public trust
• Punishing bad actors in the marketplace who do not follow the appropriate guidelines
• Providing accurate, factual information about kratom so customers have increased confidence when purchasing and see it as a safe product
• Leaving it up to states to protect its citizens by implementing the KCPA
State by State
While it is up to individual states to determine if they want to adopt the act, some states have implemented some form of it. Arizona, Georgia, Oregon, and Utah have led the way in enacting their own versions of the KCPA. However, more and more states are considering adopting individualized forms of the act.
