Although kratom is legal at the federal level in the United States, some states, cities, and counties have a ban on it. Wisconsin is one state where you can’t purchase, possess, or use kratom. The ban dates back to 2014 when the state decided that kratom wasn’t the right choice for its citizens. It’s time to take a look at kratom in Wisconsin and what the future holds.
Misinformation
In 2014, a state senator introduced a bill to ban “designer drugs,” including kratom. However, kratom isn’t a designer drug but is an all-natural plant and is part of the coffee family. Misinformation like this led to the misclassification of kratom. As a result, lawmakers erroneously decided to label kratom’s active compounds as a Schedule 1 drug. The new law meant that kratom was classified as a dangerous drug like ecstasy and heroin.
Kratom Ban Enacted
Despite the lawmakers’ lack of knowledge about kratom, 22 co-sponsors signed the bill from both sides of the aisle. The governor signed the bill into law, making the possession of kratom a felony in Wisconsin. What does this mean? Anyone caught with kratom in Wisconsin could face fines or jail time.
Formation of the AKA
Bans like this led to the formation of the American Kratom Association (AKA). The AKA was formed in 2014 to fight the type of misinformation that led to the Wisconsin ban. The group is committed to providing factual information and ensuring that kratom is accessible to consumers.
The AKA also plays a crucial role in pushing for the passage of the Kratom Consumer Protection Act (KCPA) to make kratom legal across the United States. AKA leadership recently attended a Wisconsin Senate Health Committee to give expertise and authority on kratom. The AKA members, along with other kratom supporters, sought to pass the KCPA and legalize kratom in Wisconsin. New Push
The 2023 Assembly Bill 393 sought to legalize kratom with restrictions in place. The bill, which was introduced to the Wisconsin State Assembly, aimed to remove kratom’s main alkaloids, mitragynine and 7-hydroxymitragynine, from the scheduled list of banned substances. This move would effectively decriminalize kratom in the state. While the bill has garnered support in the state legislature and among the public, it is still pending as of 2024, awaiting further deliberation and potential amendments.
