Colorado lawmakers passed the KCPA, which took effect on January 1, 2023, to establish minimum requirements for kratom products. Part of it established a system for processors to report any issues with kratom. Additionally, the act enacted penalties for vendors who sold to minors. This comprehensive legislation was designed to keep consumers safe and regulate the kratom industry in the state, providing a sense of security. While the KCPA set the tone, many believed it didn’t go far enough and pushed for even more reform.

Putting Processors on Notice

On July 1, 2024, Gov. Polis’ rules for kratom processors became stricter to hold them accountable for violations. For example, manufacturers must appropriately label all products with a complete list of ingredients. The new guidelines also punish processors who knowingly prepare, distribute, advertise, sell, or offer kratom products contaminated with a controlled or dangerous substance.

Kratom Industry Response

While many lawmakers and consumers see the stricter regulations as a positive, the kratom industry has an entirely different view. They believe the new rules are too onerous and restrictive and should be relaxed. These processors also think the guidelines will put too much of an economic burden on them. As a result, they fear they will have to foot the bill to ensure compliance. Going a step further, some vendors are worried they will have to go out of business.
