Upcoming Kratom Ban in Newport Beach, California

California is often on the cutting edge regarding supplements and natural health alternatives. It’s no coincidence that kratom is extremely popular in the state. While tons of people are gravitating toward the products, there are still plenty of roadblocks with people not fully understanding the plant. Because of this, lawmakers often throw around the idea of regulating kratom, and this time, people are calling for more action. Here’s the latest on kratom regulation in California.
Status Across the U.S.
Just for a bit of background, kratom has long been regarded as a well-respected product in Southeast Asia, where it originated. After it came to the U.S., there was much fanfare, but some in the medical community and law enforcement world felt that kratom was concerning. There have even been attempts to ban it at a federal level, but it hasn’t happened. However, a few states and individual cities and counties have prohibited kratom use, including California cities Newport Beach and San Diego.
Lack of Regulation in California
California, however, is more lax and doesn’t have much regulation. According to the Los Angeles Times, state Assembly Member Matt Haney said the state doesn’t regulate kratom at all. He added there are no age restrictions or requirements for labeling like in other states. Since kratom is so commonplace in smoke and vape shops, lawmakers feel like more should be done to keep people safe, especially minors.
Assembly Bill 2365
In February 2024, Haney proposed Assembly Bill 2365 to ensure manufacturers register kratom products with the public health department for improved oversight. Haney also wants clear and consistent labeling on all products. For example, the label would include info recommending kratom only for adults over 21. It would also warn against the use by pregnant women. The label should also indicate that users must consult a doctor before using.
Each item needs to include the number of servings. Haney also wants kratom products to include a third-party laboratory certificate of analysis. The certificate needs to let customers know what’s inside the product, including the alkaloid content and its chemical content.
The new rules would also prevent manufacturers from adulterating products with dangerous additives and ingredients. Haney said it’s vital for customers to know what they’re getting. He also wants people to know the potency beforehand to ensure they’re confident they’re making an informed decision.
Opposition to the Bill
While many applaud the bill, others say it’s too restrictive and goes too far. Specifically, the American Kratom Association believes the bill is too much and would be a costly burden on taxpayers due to its structure. The association said utilizing scientific equipment to measure specific alkaloid ratios would be too expensive, which would be passed on to customers. Many are hoping that there will be some middle ground to enact kratom regulation without being too strict.
