It has been a long, dare we say, interesting journey regarding kratom in Colorado. While the state hasn’t regulated kratom in a meaningful way, cities like Denver have an outright ban on the Southeast Asian plant. Other cities have also taken a strong stance against kratom. Recently, the state has tried to take a more cohesive approach. As a result, some lawmakers have introduced a Senate bill called “Regulation of Kratom Processors.” If passed, the legislation would make an impactful mark in Colorado for both vendors and consumers.
Denver and Other Bans
In 2017, Colorado banned kratom, but it’s a bit trickier than that. While the entire state didn’t ban kratom, only the city of Denver did. According to Westword, the Denver Department of Public Health and Environment banned selling kratom for “human consumption.” While vendors could still sell kratom, they had to clearly label products with a warning. Also, Denver vendors couldn’t provide consumers with advice on dosages or how to consume kratom products.
Denver wasn’t the only Colorado city to reject kratom. In 2019, the Town of Monument banned the retail sale of kratom. That same year, Parker’s town council passed legislation to ban kratom in that city. The bans in these cities and towns came after guidance from the FDA to ban kratom despite little to no evidence to back up their claims.
Kratom Consumer Protection Act
Several states have passed the Kratom Consumer Protection Act (KCPA) to regulate kratom and set standards. Colorado was in discussions beginning in 2019 to draft its version of the legislation. Although the KCPA was on the table, it halted due to the pandemic lockdown in February 2020. Kratom talks, however, resumed with the introduction of SB 22-120 in February 2022.
SB 22-120
According to Westword, Colorado legislators wrote SB 22-120, or “Regulation of Kratom Processors.” With this bill, the state introduced the first significant bill concerning kratom. Colorado once and for all is working to establish “statewide standards, as opposed to the current patchwork of local regulations and bans.” The American Kratom Association has thrown its tremendous weight behind the bill.
What would the bill do? It would require more stringent standards. For example, before selling kratom products, vendors would have to sign up with the revenue department and “disclose certain information regarding each of the kratom processor’s kratom products.” Additionally, the legislation would prevent vendors from selling products to customers younger than 18.
Supporters of the bill believe that it would keep customers safe and enhance the credibility of kratom. The AKA and others assert that kratom gets a bad rap due to some unscrupulous kratom sellers. These vendors often add unlisted ingredients that can be dangerous to consumers.
The KCPA would make these bad sellers accountable for their actions to protect customers. According to Mac Haddow, the senior policy fellow for the AKA, “Colorado consumers should have confidence when they purchase a kratom product that it meets the standards for purity and safety.”
