In January 2023, six state senators sponsored the bill, and from there, both chambers passed it before Gov. Jim Justice signed it into law. On June 9, the bill known as the Industrial Hemp Development Act will go into effect. According to the bill, the state will regulate kratom differently from other substances. One notable change is that kratom will only be legal for adults over 21. Also, kratom products must carry a label with a minimum warning to keep them out of the reach of children.
Additionally, manufacturers must have permits to process, manufacture, and sell kratom. These processors will also be required to sample and test kratom for purity. To further enhance safety, manufacturers must ensure products are unadulterated, with no illicit ingredients.
Reaction to the Bill 
The American Kratom Association (AKA) released a statement praising SB 220. The group’s Senior Fellow for Public Safety, Mac Haddow, said the bill ensures “kratom consumers can access safe, registered and tested products.” Kratom enthusiasts are thrilled that their favorite products will still be available.
