Except for Sarasota County, kratom has been legal in Florida as it has grown in popularity. At the same time, lawmakers have been perplexed about what to do with the Southeast Asian plant. Lucky for them, Florida lawmakers have been focusing on that issue and are getting closer to adopting the Florida Kratom Consumer Protection Act. 
Florida Kratom Consumer Protection Act
According to Florida Politics, the state is closer than ever to adopting the Florida Kratom Consumer Protection Act (KCPA). For the first time, it would “define kratom products in state statutes.” Additionally, it would prohibit kratom sales to anybody younger than 21. Violators of the law would face a second-degree misdemeanor. As a result, violations would lead to up to 60 days in jail and fines of up to $500.
Battle of the KCPA Bills in Florida
During the 2022 Legislative Session, Representative Alex Andrade and Senator Joe Gruters sponsored the KCPA bill, but ultimately, it failed. Rep. Andrade sponsored a revised, narrower bill in the 2023 Legislative Session. Andrade said, “This product is so new (here) there’s no legislative — at the federal or state level — mechanism to regulate it.” This time, it had more support, and the House voted 114-0 in favor of the bill.
Additionally, Sen. Gruters introduced a new bill awaiting a vote on the Senate floor. That bill would also define kratom products and prohibit sales to people under 21. Further, it would require kratom processors to follow rigorous testing and registration requirements. The bill would also prevent manufacturers from adding unauthorized substances that could harm consumers. Gruters said, “We want to make sure (that) it gets in the hands of the right people, that people are getting exactly what they are asking for, and it’s unadulterated.”
