Sponsored by Rep. Katie Zolnikov, HB 437 was introduced in February 2023 to revise laws regarding various substances. If passed, kratom would become a scheduled substance. As a result, kratom would be under stricter guidelines.
However, once the bill reached the Senate, legislators included an amendment to immediately ban kratom. Many felt that since it doesn’t yet have FDA approval, citizens shouldn’t be able to access it. However, many lawmakers didn’t feel the same, including the bill’s sponsor.
Ultimately, the House rejected the Senate amendment, according to NBC Montana. Rep. Zolnikov said she was against a complete ban but was open to regulation. She said she sought a middle ground that “would not jeopardize law-abiding citizens.” One of the things she was interested in seeing was an age restriction.
Opposition to Bill
