New Groundbreaking Kratom Bill Paves Way for Enhanced Protections

There’s some exciting, positive news regarding kratom on the national level. Bipartisan legislators have banned together to file a bill that would protect consumers’ kratom access. It would also prohibit various departments and legislative bodies from implementing unfavorable actions against kratom, according to Marijuana Moment. 
Federal Clarity for Kratom Consumers Act
The bill, known as Federal Clarity for Kratom Consumers Act, was sponsored by Democrats Rep. Mark Pocan and Sen. Cory Booker and Republican Sen. Mike Lee. Under the bill, it would stop the Department of Health and Human Services (HHS) from placing guidelines that are “more restrictive than allowable under the Federal Food, Drug, and Cosmetic Act (FDAC).” 
Additionally, the bill would stop the HHS from treating kratom or another kratom-derived product as a supplement that’s adulterated. This would keep kratom more accessible to consumers without unnecessary loopholes.
Reason for the Bill
The main reason for the bill is to prevent various federal agencies from restricting consumer access. Legislators who sponsored the bill say they have heard numerous stories about how kratom has benefited consumers all over the country. They believe that it’s unfair how kratom is targeted and want it on par with similar products. Since the FDA has not yet enacted kratom guidelines, lawmakers want the body to step up to protect customers.
The bill is also crucial because it would block the criminalizing of kratom and those who distribute, purchase, and possess products. As a result, kratom would remain fully legal and accessible to those who need it most.
Specifics of the Bill
Under the bill, it would require HHS’s secretary to hold a minimum of one open hearing. The meeting would concentrate on scientific data regarding kratom, as well as the benefits and risks of the products. Scientific researchers would provide factual knowledge to educate and inform consumers, lawmakers, and more. Additionally, the HHS would have to provide a docket open to the public a minimum of 30 days before the meeting for the public to provide their input.
The act also calls for HHS to establish the Kratom Research Task Force. The group would “coordinate kratom-related research conducted or supported by the Federal Government.” Further, the group would hold public meetings with experts in the field and the appropriate stakeholders. The meetings would serve to raise public awareness around kratom-related research.
Consequently, the task force must submit its findings to the HHS secretary and Congress. Every quarter, the group would have to keep Congress updated on the latest research. Two years after providing its first report, the panel would dissolve.
Significance of the Act
Since lawmakers authored the act, the bill has garnered significant attention since it’s the first standalone piece of legislation that tackles kratom. It also stands out since the bill has bipartisan and bicameral support. Mac Haddow of the American Kratom Association said, “The introduction of this legislation is a landmark victory for kratom consumers across the country.”
However, it is crucial to note that the bill would not preempt any state laws since they vary from state to state.
