Michigan Turning an Eye Toward Kratom

Archives

July 20, 2022

Similar to several other states, Michigan is another place that is turning its eye to kratom. This time, the state’s lawmakers want to regulate kratom, including stricter testing, prohibiting sales to youth, and requiring licensing. The sponsored bill has pertinent information that any kratom lover should read and understand.
Background on the Bill
Two state representatives and several reps from both parties sponsored the bill. The goal was to highlight kratom, which many still don’t understand. Because of this, there’s plenty of misinformation available about what kratom is and what it can and cannot do. For example, one of the bill’s sponsors admitted she had never heard of kratom when a constituent showed her a product. As a result, lawmakers feel the need to legislate the Southeast Asian plant and limit who can get their hands on kratom.
What’s in the Bill
According to Bridge Michigan, the “bill would create the Kratom Consumer Protection and Regulatory Act.” One of the bill’s sponsors said the act would create a practical approach to overseeing and regulating kratom. It would help to put solid regulations into place.
Per the bill, legislators would expect manufacturers to comply with exacting labeling requirements. The law would ensure that customers know exactly what they’re getting. As a result, consumers could make more informed choices about whether kratom suits their wants and needs.
Lawmakers also want to prevent retailers from selling kratom to anyone under 21. There would be fines and consequences for stores that sell to underage people. According to one of the bill’s sponsors, the reasoning is “because we don’t want our youth enticed by one more thing.” However, the sponsor admitted that while they believe there are issues with kratom, it “is not problematic for everyone.”
Additionally, the bill includes text requiring vendors to get a license to manufacture, distribute, and sell kratom. Raw materials also must be tested to ensure the product is pure with no additives. Further, manufacturers must include warning labels on kratom products.
What happens next?
If the bill passes, it will take effect on January 1. Not only would it apply to brick-and-mortar stores but also to online vendors. There’s no guarantee that the law will pass since mostly Democrats sponsored the bill, and Michigan’s legislature is Republican-controlled. Some governmental departments have already expressed their opposition to the bill.
