While kratom is legal in New York, there have been times throughout its history when lawmakers have attempted to ban it. Why? 2017 Total Ban Attempt 
At the beginning of 2017, New York wanted to take a strong stance against kratom by introducing two bills. In January, lawmakers sought to prohibit the sale or distribution of kratom throughout the state. Essentially, that would have outlawed kratom, where nobody could use or possess it. While that didn’t pass, New York lawmakers didn’t give up.
2017 Age-Restricted Ban Attempt 
In October 2017, New York tried a different approach and attempted to restrict the sale of kratom to minors under 18. If any vendor tried to sell kratom to anybody underage, the person could face a fine of $500. However, a grassroots campaign headed by the American Kratom Association prevented the bill from becoming law. As a result of the failure of both pieces of legislation, kratom remained legal and readily available to all New York citizens.
2021 Pending Bill 
After a few years, in 2021, New York legislators once again tried to restrict kratom. This time, the state wanted to ban kratom use and possession for citizens under 21. Any vendors who violated the law would be fined $500. While this bill is still ongoing, there is a good chance it could pass since it has plenty of support. However, kratom warriors are speaking up in opposition.
