Kratom Legislation Shot Down in Florida
Many states have decided to take on kratom, and many have seen kratom win. Florida is another state that’s attempted to regulate kratom on the House and Senate sides. However, the intended legislation didn’t work out how legislators would like in either case, and kratom won. For the latest kratom battle in Florida, you need to understand the background of kratom in the state, the latest regulation, and what kratom watchers expect to happen.
Senate Bill
In November 2021, State Senator Joe Gruters filed the Kratom Consumer Protection Act. The bill aimed to prevent under 21-year-olds from purchasing kratom. It also sought to prohibit manufacturers from adding dangerous ingredients to kratom. According to Florida Politics, the bill would also prevent manufacturers from making false health claims on product labels.
Violators of the law would face stiff penalties, including $500 for the first offense and then $1,000 for repeat offenses. It won unanimous support in two committees. However, it faced resistance in the Senate Appropriations Committee and, ultimately, died in committee.
House Bill
On the House side, Rep. Alex Andrade filed a bill to regulate kratom in December 2021. According to The Florida Senate, the legislation would prevent “manufacturers from preparing, packaging, distributing, selling, or exposing for sale certain kratom products.” Manufacturers that broke the rules would face penalties. Despite Andrade’s push, the bill went unheard.
Moving Forward
These two bills, along with past ones, have all failed. Kratom regulation doesn’t seem to stand a chance in Florida now or in the future. Anytime the state has attempted to take on kratom, the American Kratom Association and kratom supporters have fought back. As a result, kratom has remained legal and accessible to citizens.
