Oregon KCPA in Trouble, Governor Threatens to Veto
Kratom warriors rejoiced when word came out that Oregon passed its version of the Kratom Consumer Protection Act. Yes, kratom lovers all over the state were rejoicing! However, that excitement dissipated when Oregon Governor Kate Brown announced that she would veto the legislation. Wait, what happened? Let’s get ready to take a closer look at kratom in Oregon and the governor’s position.
Oregon KCPA
Before we get into the governor’s stance, you need to understand what the KCPA is and what it does. Lawmakers passed the act in June 2021. The legislation gained bipartisan support “to create a regulatory framework for the sale and use of kratom for adults,” according to Marijuana Moment. Under the KCPA, adults over 21 can freely purchase kratom.
Standards Set in Place
To sell kratom, vendors would have to register with Oregon’s Department of Agriculture. The department would also set labeling requirements and testing standards to ensure high-quality kratom. Additionally, the legislation would prevent vendors from selling adulterated, diluted, or contaminated kratom products.
Governor’s Intent to Veto
By August, Governor Brown “announced her intent to veto” the Oregon KCPA. Her reasoning? She believes that the FDA is the best body to regulate kratom. She said, “I would entertain further legislation to limit youth access without the state agency regulatory function included in this bill.”
Disappointment Over Veto
Kratom supporters were quick to express their disappointment. More than anything, they want products better regulated to protect customers. They believe that consumers would end up with safer products and better outcomes with the KCPA in place. Republican Rep. Bill Post, a sponsor of the legislation, wrote in an op-ed, “Kratom in its pure form is a natural product. Adulterated kratom is a potentially dangerous product.” Supporters want to draw a clear line between pure, all-natural products and adulterated ones.
With adulterated kratom products, they may contain unknown chemicals and substances that can cause health problems. As a result, kratom gains a bad reputation and makes consumers want to stay away. More stringent legislation like the KCPA would keep adulterated products out of the hands of consumers.
