The State of Kratom in the State of Vermont
2021 is the year that Vermont is taking a closer look at kratom and its legality in the state. Currently, kratom is illegal in the state, and lawmakers have previously placed the plant’s main alkaloids, mitragynine and 7-hydroxymitragynine, on the Controlled Substance list. There seems to be a change on the horizon, however. Legislators are looking to decriminalize the plant and making it more accessible to the masses. History of Kratom in Vermont
Vermont lawmakers placed mitragynine and 7-hydroxymitragynine on its Controlled Substance list back in 2016. The list includes various synthetic cannabinoids, which is why many people took issue with the kratom ban. Despite what some think, kratom is an all-natural plant native to Southeast Asia. Many people find this inaccurate and have been fighting for years to free kratom from the restrictive list. For added confusion, the state has never officially banned kratom, only its alkaloids.
Plans for Decriminalization
In February 2021, lawmakers put forward two bills to decriminalize kratom in the state. State Rep. Selene Colburn said that humans have long had a relationship with plants like kratom. According to Marijuana Moment, she said, “But the legacy of colonization has left us with the criminalization of these medicinal, spiritual, religious, entheogenic medicines.”
The introduced bill would regulate the sale of kratom and de-stigmatize the plant to allow Vermont’s citizens to safely and legally purchase and possess kratom. Kratom would essentially be taken off regulated status and no longer considered a controlled substance.
Kratom Consumer Protection Act
Although kratom is grouped with various other plants, Vermont lawmakers planned to deal with the plant under different legislation. Legislators planned to use the Kratom Consumer Protection Act to legalize and regulate the sale of kratom products. The act would include guidance about labeling, purchasing age, purity and safety standards, and more.
Is Kratom Decriminalized?
As of now, the kratom legislation hasn’t progressed much because kratom is still illegal in Vermont. Kratom warriors are still fighting to make it legal and to spread the truth about what the plan is and is not. Supporters believe the more facts they put out there about kratom, the better the chance to make it legal.
