Call for Kratom Reform, Not a Ban
While there are die-hard critics and opponents of kratom, there are just as many, if not more, supporters and proponents of kratom. These folks argue that blanketed bans are not the way forward regarding the Southeast Asian plant. Instead, supporters believe that there needs to be sensible reform when it comes to kratom. Recently, an assistant law professor at the University Of Massachusetts School Of Law, Dustin Marlan, laid out the best path forward.
Problem with Adulteration
Kratom opponents often point to cases like the recent one where authorities seized approximately 37,000 tons of kratom. However, supporters highlight that authorities only seized the products because they were adulterated. It wasn’t that the kratom was dangerous in its natural state, but unscrupulous manufacturers add harmful substances to increase sales.
Overreaction to Headlines
Marlan says that this type of misleading headline and overreaction gives kratom a bad name. These types of issues might turn people off the products since they fear that they are dangerous. However, Marlan says that is far from the truth. While there has been a lack of kratom research, no large-scale studies have proven that the plant is dangerous.
According to Harvard Law, Marlan argues that prohibiting kratom would be a mistake and said there’s no scientific reason to schedule the plant. He also stated that banning kratom could only exacerbate the circumstances surrounding it. Marlan said that would lead to people turning to unregulated substances that could carry health repercussions.
Repercussions
Marlan explained that taking kratom away would be “cruel and unusual.” Marlan added, “Moreover, if the FDA tried and again failed in its misguided quest to prohibit kratom, it would be an enormous setback for the agency and further erode consumer confidence.”
Solutions
According to Marlan, the FDA “should strengthen consumer confidence by creating uniform federal regulations for kratom.” He said that suppliers shouldn’t be able to sell adulterated kratom under any circumstances. Manufacturers should also properly label kratom, and vendors shouldn’t sell products to anyone under 18, according to Marlan. He concluded with “through these sorts of sensible regulations that both advocates and critics can come to a non-dualistic understanding of kratom reform…without introducing needlessly punitive measures.”
