What do you know about import alert 54-15? A hint: it involves kratom. The FDA reissued the alert as further guidance to its field personnel to seize products that contain kratom at any U.S. border. What Does the Order Mean?
Under the order, there are dozens of products from various companies that agents can detain without examination. The FDA has used the Detention without Physical Examination (DWPE) since about 2014 to seize products from companies in the United States, Canada, Philippines, Malaysia, and Indonesia. According to Natural Products Insider, the FDA says the order is to protect customers safety issue is the crux of 54-15. The group says there’s still not an abundance of scientific research on the Southeast Asian plant.
What Does the AKA Think?
The American Kratom Association, or AKA, has a few thoughts on the alert. On the one hand, the organization believes that it serves an important role. The senior fellow on public policy, Mac Haddow, says “the import alert is appropriate for processors importing kratom into the U.S. for the purpose of marketing it as a dietary ingredient.”
However, Mr. Haddow believes the FDA is overstepping its authority. The AKA says the FDA should consider the intended use of targeted products and how producers market them. Mr. Haddow thinks the organization can’t stop wholesalers from bringing raw materials into the U.S. Also, he argued that the FDA “has no authority to take action against non-adulterated, uncontaminated kratom sold as food with no health or dietary ingredient claims.”
